4 Questions to Ask Before Choosing an Islamic Home Financing Provider

Before choosing an Islamic home financing provider, ask about ownership, true co-ownership, risk-sharing, and Shariah board oversight. Guidance Residential is Muslim-owned, creates real co-ownership through an LLC, shares risk with homebuyers, and is overseen by an internationally recognized Shariah board

1. Is the company Muslim-owned and Muslim-led, or a subsidiary of a conventional bank or lender?

Ownership determines where the money comes from and where the profits go. Find out whether the company is a subsidiary of a riba-based institution. When the financier is a subsidiary of a bank, the funding for your home comes from riba, and the profits flow back into riba.

Guidance’s answer: Guidance Residential is independently Muslim-owned and Muslim-led. It is not a bank or a subsidiary of a bank.

2. Does the contract create true co-ownership, with the provider holding a real stake in the property?

In true Musharakah, or co-ownership, the provider purchases the home with you, and it maintains a stake in the home until you finish buying out its shares of the property and become the sole owner. This ensures that both party share in the risks of the venture.

Guidance’s answer: Yes. Guidance creates an LLC for every home financed, and the company and the homebuyer purchase the home together.

3. Does the company share risk with you in cases like natural disasters or eminent domain?

Risk sharing is a foundational principle of Islamic finance. In an authentic program, if disaster strikes and insurance falls short, the loss is shared in proportion to ownership, not pushed entirely onto the homebuyer.

Guidance’s answer: Yes. Guidance’s LLC structure enables true risk sharing, where both parties would share certain losses (such as in the case of natural disasters or eminent domain) in proportion to their ownership share.

4. Who sits on its Shariah board, how large and robust is the board, and are they internationally recognized scholars?

Look for a large, diverse board of internationally recognized scholars with ongoing oversight, not one-time approval or a board that is small or local.

Guidance’s answer: Guidance’s independent Shariah Supervisory Board is composed of internationally recognized scholars and chaired by Justice Muhammad Taqi Usmani, who also chairs the Shariah board of AAOIFI, the global standard-setting body for Islamic finance. The board reviews the company’s activities continuously and conducts annual audits.
